GENERAL SALES CONDITIONS GENEROUS

ARTICLE 1. Scope of Application

The present General Sales Conditions apply and are obligatorily imply the unconditional acceptance of any person having ordered products offered for sale by GENEROUS SA.

They specify in particular the applicable conditions of order, payment, delivery, as well as the conditions of possible returns of products ordered by a Customer.

ARTICLE 2. Définitions des termes utilisés dans ces Conditions Générales de Vente

– « GSC » : refers to the existing General Sales Conditions
– « Customer(s) » : refers to any major or minor over 16 who has obtained the authorization of their parents or guardian to register and place an order on Generous’ company Website.
– « Account » : refers to the personal account created by the Customer on the Website.
– « Order(s) » : refers to any order for Poroducted placed by the Customer on the Website.
– « Product(s) » : refers to the Products offered for sale by Generous on its Website.
– « Website » : refers to the company e-shop, better known under the URL http://
– « Generous » refers to the company GENEROUS SA as identified in the Article 1 “Scope of Application”.

ARTICLE 3. Products

The Products offered for sale are those accessible via the Website and available at the time of the Order, while stocks last.

In the event of a stock shortage of the product(s) ordered, the Customer will be informed as soon as possible. In addition, Generous will do its utmost to replenish the missing stocks. By notification of a possible stock shortage to a Customer, Generous may offer a cancellation of the Order as well as a Refund, or a postponement of the delivery date as a last resort once the requested products are restocked.

Generous does not guarantee the absence of errors on the Website, in particular concerning the available stocks. However, Generous will be under the obligation to make its best efforts to correct any error reported by a Customer as soon as possible.

ARTICLE 4. Specific Product Features

Generous products include artisanal organic and gluten-free cookies, as well as various baking aids. Therefore, the Customer agrees to read carefully the product sheets (list of ingredients, allergens, nutritional values, etc.) as well as its labeling before consuming them to ensure that the product is safe for the consumer, certain products containing allergens (eggs, milk, etc.).

ARTICLE 5. Price

The prices of the Products displayed on the Website are indicated in euros, all taxes included. Shipping costs are not included in the price displayed on the product sheets.

Generous is liable to modify the ranges of Products as well as the associated prices at any time and at its discretion. The prices applicable to a certain Order remain those displayed on the Website and on the invoice at the time of validation and payment of the Order by the Customer.

ARTICLE 6. Account

6.1 Account Creation

The Customer can create an Account by browsing the Website, regardless of the placing of an Order.

To this end, the Customer must:

  • Create a unique identifier by indicating your email address
  • Create a unique password
  • Provide the following information: Gender, Surname and First name
  • Indicate his date of birth (optional)
  • Indicate whether he wishes to be contacted by Generous by electronic means in the context of commercial prospecting, by checking the box provided for this purpose.

When the Customer wishes to place an Order, he is required to create an Account if he has not already done so.
In order to be able to place an Order, the Customer must also provide the following information:

  • Civility
  • Last name and first name
  • Exact delivery address
  • Billing address if different from the delivery address
  • Telephone number

Accept the GSC by checking the box provided for this purpose

The Customer has the duty to guarantee the accuracy of all the information he provides and undertakes to immediately notify Generous of any modification of this information and / or by updating his Account.

Generous may refuse the registration and the Order of a Customer in case of non-compliance with the GSC without having to justify it and without such a refusal generating a right of recourse or any compensation.

6.2 Access to Account

The Customer can access its Account by entering his unique username and password at any desired time, the Website being available 24/7.

6.3 Account management

From his Account, the Customer has the possibility to :

  • Consult the history of his Orders
  • Download previous invoices
  • Fill in optional information, and / or modify all or part of the information already entered

6.5 Account suspension or deletion

The Customer has the possibility to delete his Account at any time by contacting Generous by email at info@generous.eu or by deactivating directly his account. In the event of non-compliance by the Customer with all of the GSC set out in this document, or in the event of knowledge of an illegal activity by the Customer on the Website, Generous reserves the right to suspend or delete the Customer account without notice.

ARTICLE 7. Order

 7.1 Placing of the Order

The connection by the Customer to his Account by entering his username and password makes it possible to identify him reliably and binds him for any Order placed through this.

For any Order placed, the Customer is asked to select the Products desired by adding them to his personal basket, which can be viewed at any time. The Customer can confirm his Order at any time by choosing the payment and delivery methods he wishes.

7.2 Payment and Order Confirmation

Payment for the Order is made by xx using the secure interface made available to the Customer by the payment provider xx.

Orders placed engage Generous only after confirmation by the Customer’s bank of full payment of the Order including shipping costs when they are not offered.

Once the Order has been validated, the Customer receives a confirmation email on the address previously registered in his Account.

7.3 Reimbursement terms

For any Product Order made by xx : reimbursement will be made by xx.

ARTICLE 8. Delivery

Generous supplies the whole the following European countries: Belgium, France, Luxembourg, Autriche, Netherlands, Germany, United Kingdom, Italy, Spain, Portugal, Sweden, Danemark, Finland. The carrier is Bpost. Only home delivery is available on the Website. Whatever the delivery method chosen by the Customer, the Customer himself undertakes to check the conformity of the Order.

The delivery time can vary between 2 to 10 working days depending on the country of destination. The delivery costs have to be paid by the Customer for deliveries in Belgium and abroad. The Products are shipped in suitable packaging to guarantee their conservation.

8.1 Late delivery

For any problem related to the delivery of an Order, the Customer is invited to report it to the address info@generous.eu so that Generous can approach the transporter in order to resolve the problem encountered.

8.2 Cancellation of the Order linked to a delay or absence of delivery

If delivery does not take place, the Customer may request the cancellation of the Order and its full refund. In this case, the Customer will be carried out within a maximum of fourteen (14) days.

No refund will be due in the event of delay or failure to deliver without fault by Generous, or in particular due to a lack of address (example: incorrect address).

ARTICLE 9. Right of withdrawal

The Customer has a right of withdrawal which he can exercise within a period of fourteen (14) days from the date on which the Customer took possession of the Order.

9.1 Withdrawal due to litigation or faulty Order

The request for withdrawal must be made by the Customer by email to the address info@generous.eu explicitly and clearly indicating the reason for its decision to withdraw. Photos must be attached to the withdrawal email when a product is delivered damaged, if the product does not correspond to the Order, or if the date of consumption has passed.

The return of a product is only allowed if the latter is returned intact to the company’s registered office (Generous SA, 13 rue Bollinckx 1070 Bruxelles). The product must be in its original packaging, not unwrapped and not damaged. Return costs are the responsibility of the Customer. The Customer must return the package against signature upon receipt.

Any shipment that could compromise its traceability will be refused.

Once the dispute of the non-conformity of the product has been accepted, Generous will send a new identical product within 10 days, depending on its availability.

9.2 Order refund

The above protocol explained in Article 9.1 “Withdrawal due to litigation or faulty Order” is applicable if the Customer wishes a refund of his Order. No other protocol can be accepted against a refund.

The reasons for the refund must be clearly indicated in the email sent to info@generous.eu  The product must be returned intact at the registered office upon signature upon receipt of the return. Generous will issue a full refund within 10 days of receiving the package.

9.3 Not accepted exchanges and refunds

Exchanges and refunds will not be accepted if the period of fourteen (14) days is exceeded, if the price of the product has changed on the market, during sales or promotions and if the product that you returned to us is worn, damaged or modified by the Customer.

ARTICLE 10. Responsibility

The responsibility of Generous may not in any event be engaged in the event of non-performance or poor performance of contractual obligations attributable to the Customer, in particular when entering his Order or non-receipt of the Order. Generous cannot be held responsible, or considered to have failed in the present, for any delay or non-performance, when the cause of the delay or non-performance is linked to a case of force majeure as defined by the case law of Belgian courts and tribunals.

ARTICLE 11. Personal data

The Customer’s personal data (such as his last name, first name, email, age, address, telephone) are not disclosed to any third company, any legal person or any natural person who is not part of the staff of Generous, as well as messages left on the Website.

The Customer’s personal data remains encoded only in the internal Generous database for an indefinite period, if and only if it has been voluntarily submitted by the Customer. The only people who have access to the Customer’s personal data and to their messages left on the Website are: the manager and co-manager of the company, the sales manager and the person in charge of sending packages.

The Customer’s personal password is encrypted in the Generous database so that Generous cannot access it. If the Customer loses his password, it is impossible for Generous to recover it. The Customer will therefore be asked to reset it. The password reset procedure is done via the email address provided by the Customer when registering.

The Google Analytics system can sometimes be used to carry out analyzes concerning in particular the number of daily visitors. Therefore, Google is entitled to register the IP address of the Customer to geo-locate the Customer and define in which country the Website generates the most visits.

All Orders made by a minor under the age of 16 cannot be accepted. Only orders placed by adults or minors over the age of 16 who have obtained the authorization of their parents or guardian to register and place Orders may be accepted. Otherwise, Generous may cancel all Orders and proceed to the deletion of all personal data recorded.

As indicated in Article 7.2 “Payment and Order Confirmation”, the various means of payment used by Generous are managed through the company xx. Xx and Generous have no access to the Customer’s banking data as they are not registered in any of the databases of these two companies respectively.

The personal data of the Customer are used for the delivery of his Order and for sending a Newsletter promoting new products, if and only if the Customer has decided to subscribe to it. No advertising will be sent to the Customer without his agreement.

When Generous carries out contests, the personal data collected during the participation of the Customer will be used to contact him if he is the winner of the contest.

Personal data could, if necessary, be communicated at the request of the judicial authorities or the police without the prior consent of the Customer.

ARTICLE 12. Intellectual Property

The Website constitutes a work protected by copyright, full property of the company Generous. All of the elements that compose it belong entirely to the company. No element of the Website may be used, reproduced, represented, disseminated by any technical process without the prior written consent of the company Generous.

ARTICLE 13. Changing of the GSC

Generous can modify the terms of these GSC at any time, and discreetly. These modifications systematically commit the Customer as soon as they are put online.

ARTICLE 14. Applicable right

The GSC and all relations with Customers are governed and interpreted according to Belgian law, regardless of the location of the Customer accessing the Website.

ARTICLE 15. Customer right

The Customer has the legitimate right to demand to see, modify, or delete all personal information concerning him from Generous.

ARTICLE 16. Mediation and disputes

Only the French-speaking courts of Brussels (Commercial Court or Justice of the Peace) are competent in the event of a dispute between the parties. The possible provisions of the buyer do not constitute any derogation from the aforesaid attribution of competence.
